2. Scope and Definitions
2.1 These Terms govern your use of the Xpreso platform and services for candidates / job seekers ("Candidate Services") in Germany.
2.2 "Consumer" means a natural person acting predominantly outside a trade, business or profession.
2.3 "Platform" means our website, apps, and any related services, including voice-first conversation flows and candidate profiles.
2.4 "AI" means automated systems that can generate text, speech, summaries, structuring, and recommendations.
3. Eligibility and Account
3.1 You must be at least 18 years old to use the Platform.
3.2 Some features require an account. You must provide accurate information and keep it up to date.
3.3 You must keep your login details secure and notify us immediately if you suspect misuse.
4. What We Do (and What We Don't Promise)
4.1 Xpreso helps you:
- (a) run structured, voice-first conversations to understand your preferences, constraints, skills, and goals;
- (b) create and enrich a candidate profile (including summaries and fit signals);
- (c) identify potential opportunities and—only with your consent—introduce you to employers.
4.2 We do not guarantee interviews, offers, hiring outcomes, salary levels, or any specific career result.
5. Voice Calls, Transcription, and AI Output
5.1 You actively start voice interactions (e.g., "Start Call"). We do not require always-on listening.
5.2 By using voice features, you consent to real-time transcription and processing of your input to deliver the Candidate Services.
5.3 AI limitations: AI may produce incorrect, incomplete, or misleading output. Always verify important facts yourself. AI output is not legal, tax, or professional advice.
5.4 No binding declarations: AI interactions do not create legally binding promises by Xpreso or employers. Any employment relationship is solely between you and an employer.
6. Opt-in per Employer (Introductions)
6.1 We share your profile with an employer only if you explicitly opt in for that employer ("Employer Opt-in").
6.2 Before you opt in, we will provide you with at least:
- (a) the employer's identity; and
- (b) the context/role; and
- (c) the categories of information that would be shared.
6.3 You can withdraw an Employer Opt-in at any time for the future. We cannot technically "take back" data already shared with an employer, but we will request deletion where appropriate.
7. Your Content and Rights
7.1 You may provide content such as CVs, links (LinkedIn/GitHub/portfolio), text, and voice input ("User Content").
7.2 You confirm you have the rights to provide such User Content and that it does not infringe third-party rights.
7.3 You grant Xpreso a non-exclusive, worldwide, royalty-free license to host, store, process, transform, and display User Content solely to operate and improve the Candidate Services (including generating transcripts, summaries, fit signals, and—only after Employer Opt-in—employer introductions).
7.4 You keep all ownership rights in your User Content.
8. Prohibited Use
You must not:
- (a) provide false, deceptive, or unlawful information;
- (b) upload content you do not have rights to;
- (c) use the Platform to harass, discriminate, or violate laws (including the German AGG);
- (d) attempt to break, probe, or overload the Platform or circumvent security measures;
- (e) scrape, copy, or mass-export data without our consent.
9. Availability and Changes to the Platform
9.1 We may update, modify, or discontinue features to improve the Platform, comply with law, or for security/operational reasons.
9.2 If changes materially reduce core functionality for consumers, we will consider your legitimate interests and applicable mandatory law.
10. Term, Termination, Account Deletion
10.1 You may stop using the Platform at any time.
10.2 You can request account deletion (where available in-app or via support). Some data may be retained where required by law or legitimate interests (details in our Privacy Policy).
10.3 We may suspend or terminate access if you materially breach these Terms, misuse the Platform, or create security risks. For consumers, we will consider proportionality.
11. Liability
11.1 Unlimited liability: We are liable without limitation for intent and gross negligence and for injury to life, body, or health.
11.2 Essential obligations: For simple negligence, we are liable only for breach of essential contractual obligations (cardinal duties) and limited to foreseeable, typical damages.
11.3 No liability for lost opportunities: To the extent permitted by law, we are not liable for lost job opportunities, lost profits, or indirect damages.
11.4 Mandatory liability remains unaffected (e.g., Product Liability Act).
12. Mandatory Consumer Rights (Digital Services)
If mandatory German consumer rules on digital services apply to the Candidate Services, your statutory rights remain unaffected and prevail over conflicting clauses.
13. Privacy
We process personal data in accordance with our Privacy Policy, available on our website/platform. For introductions, we use an Employer Opt-in model.
14. Amendments to These Terms
14.1 We may amend these Terms for valid reasons (e.g., legal changes, security, product changes).
14.2 We will notify you of material changes in advance. If you continue using the Platform after the effective date, the updated Terms apply unless you object. Mandatory consumer law remains unaffected.
15. Governing Law and Jurisdiction
15.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
15.2 For consumers: This choice of law does not deprive you of mandatory consumer protection provisions of your habitual residence.
15.3 Jurisdiction: For consumers, statutory venues apply.
17. Consumer Dispute Resolution (VSBG)
We are not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
